PUBLIC OFFER (AGREEMENT)
about participation in the webinar and about the processing of personal data

This Public Offer (hereinafter referred to as the "Offer") is an official public offer of the Organizers, specified in Section 12 of this Offer, to conclude an agreement on participation in a free online event (webinar) on the terms set out below with any legally capable individual who wishes to participate in it.
In accordance with Articles 633, 634, 641, 642 of the Civil Code of Ukraine, this Offer is a public agreement. Its unconditional acceptance (acceptance) is carried out in the manner specified in Section 3 and is equivalent to the conclusion of an agreement on the terms of this Offer. At the same time, the Offer is a document by which the Organizers fulfill their obligation to inform the subject of personal data within the meaning of Article 12 of the Law of Ukraine "On Personal Data Protection".
1. Terms and definitions
“Organizers” are jointly two companies that organize and conduct the Webinar and act as controllers of the Participants’ personal data: (1) LLC “Finmap” EDRPOU 13281743 (hereinafter referred to as “Finmap”) and (2) JSC “CREDIT AGRICOLE BANK”, EDRPOU 14361575 (hereinafter referred to as “Credit Agricole”). Each of the Organizers is an independent controller of personal data for its own processing purposes as defined in this Offer.
“Webinar” is an online educational and/or informational event conducted by the Organizers remotely using the Internet, on the topic Will your business survive a downturn and how to check it before it happens, the estimated date of the event is July 16, 2026.
“Participant” / “User” is a capable individual who has reached the age of 18, has registered for the Webinar and accepted this Offer.
“Registration” is the provision by the Participant of his/her personal data by filling out the electronic registration form for the Webinar at the link [https://lp.finmap.online/webinar-credit-agricole].
“Acceptance” is the Participant’s full and unconditional acceptance of the terms of this Offer in the manner specified in section 3.
“Personal data” is information or a set of information about the Participant as an individual who is identified or can be specifically identified.
“Processing of personal data” means any action or set of actions, including collection, registration, accumulation, storage, adaptation, modification, updating, use and dissemination (transfer), depersonalization and destruction of personal data.
“Privacy Policy” means the documents of the Organizers that regulate in detail the processing of personal data and are posted at the following addresses: Finmap Policies and Credit Agricole Policies. The Privacy Policies are an integral part of this Offer.
2. Subject of the Offer
2.1. The Organizers provide the Participant with the opportunity to register for the Webinar free of charge and take part in it, as well as receive accompanying materials for the event (link to the broadcast, presentations, recording - if available and at the discretion of the Organizers).
2.2. Participation in the Webinar is free of charge. The Offer does not provide for any financial obligations of the Participant to the Organizers.
2.3. A mandatory condition for participation in the Webinar is the provision by the Participant of personal data necessary for its organization and acceptance of this Offer. A person who does not provide such data or does not accept the Offer cannot be registered as a Participant.
3. Procedure for Accepting the Offer
3.1. Acceptance of this Offer is considered to be a set of the following actions of the Participant taken during Registration:
filling out the electronic registration form with accurate personal data; and
checking the appropriate box to review the terms of this Offer and the Privacy Policy and consent to the processing of personal data; and
clicking the registration completion button ("Register" or similar).
3.2. The consent mark is not pre-marked. The registration form is designed in such a way that it does not create the possibility of processing the Participant's personal data until he puts such a mark and completes Registration.
3.3. By taking actions to accept, the Participant confirms that he has reached the age of 18, is fully capable, has read and fully agrees with the terms of this Offer, and the data provided by him are accurate and belong to him personally.
4. Data owners, data composition and sources
4.1. The owners of the Participants' personal data are both Organizers - Finmap and Credit Agricole. Each Organizer independently determines the means and is responsible for the processing of personal data within its own purposes, defined in section 5.
4.2. The Organizers process the following categories of personal data that the Participant voluntarily provides during Registration and participation in the Webinar:
surname, first name (if necessary - patronymic);
email address;
telephone number;
company name and position of the Participant;
technical data collected automatically when connecting to the Webinar and interacting with the site (IP address, device and browser data, cookies, date and time of connection, data on the progress of participation in the event).
4.3. The Organizers do not collect or process sensitive (special) categories of personal data (about racial or ethnic origin, health status, religious beliefs, etc.) within the framework of this Offer. The Participant undertakes not to indicate such data in the fields of the registration form.
4.4. The source of personal data is the Participant himself. By providing the data, the Participant confirms that they are reliable and relate to him personally.
5. Purpose and legal grounds for processing
5.1. The Participant's personal data are processed by the Organizers for the following purposes:
(a) Organization and conduct of the Webinar - registration of the Participant, sending links to connect, reminders, presentations, recordings and other materials of the event, communication with the Participant on issues related to the Webinar;
(b) Analytics and improvement of events - formation of depersonalized statistics of attendance and quality of the Webinar, assessment of the effectiveness of the partner event;
(c) Marketing communications - with the separate consent of the Participant (clause 5.3) - sending by each of the Organizers information, advertising and marketing messages about their own products, services, promotions and events via e-mail, telephone and messenger channels;
(d) Compliance with legal requirements - in cases and to the extent provided for by the current legislation of Ukraine.
5.2. The legal grounds for processing are: for purposes (a) and (b) - the need to conclude and perform a transaction (participation in a free event), to which the Participant is a party, as well as the Participant's consent provided by accepting this Offer; for purpose (c) - the Participant's separate voluntary consent; for purpose (d) - the fulfillment of the controller's obligation stipulated by law (Article 11 of the Law of Ukraine "On Personal Data Protection").
5.3. Consent to marketing communications is voluntary and separate. Refusal to provide it does not deprive the Participant of the right to participate in the Webinar. Such consent is provided by making a separate mark in the registration form and can be withdrawn at any time in accordance with the procedure set out in Section 7.
6. Data transfer between the Organizers and third parties
6.1. Mutual transfer between the Organizers. The Participant agrees that his personal data collected during Registration are transferred between both Organizers (Finmap and Credit Agricole) and processed by each of them independently for the purposes specified in section 5. Both Organizers are equal recipients and owners of such data.
6.2. Processors (third parties processing data on behalf of the Organizers). For the organization of the Webinar and communications, the Organizers engage processor services, in particular:
the platform for conducting online webinars Zoom; Webinar Stars;
the email and messenger service Sendpulse; Smartsender.
6.3. Cross-border transfer. The Participant is informed and agrees that individual processors may be located outside Ukraine. Data transfer to such persons is carried out only on condition that they ensure an adequate level of personal data protection in accordance with the requirements of the legislation of Ukraine and, where applicable, Regulation (EU) 2016/679 (GDPR).
6.4. The Organizers do not sell the personal data of the Participants or transfer them to other third parties, except for the cases specified in this Offer or expressly provided for by law (in particular, upon a lawful request of authorized state bodies).
7. Rights of the Participant as a subject of personal data
7.1. The Participant has all the rights provided for in Article 8 of the Law of Ukraine "On Personal Data Protection", in particular the right to:
know about the sources, location, purpose of processing and owners of their personal data;
receive information about the conditions for providing access to their data and access to them;
request correction (update) of inaccurate or incomplete data;
request deletion (destruction) of their personal data if they are processed unlawfully or are no longer necessary for the purpose for which they were collected;
object to the processing of their data for direct marketing purposes;
withdraw consent to the processing of personal data;
file complaints regarding the processing of their data with the Commissioner for Human Rights of the Verkhovna Rada of Ukraine or with the court.
7.2. Withdrawal of consent. The participant may withdraw their consent (in whole or in part) at any time by sending a corresponding request to support-team@finmap.online and, as for newsletters, also by clicking on the “Unsubscribe” link in each email. Withdrawal of consent is as simple as its provision and does not require an explanation of the reasons.
7.3. Withdrawal of consent does not affect the lawfulness of the processing carried out up to the moment of withdrawal. After withdrawal, the Organizers shall terminate the relevant processing and destroy the data, unless there is another legal basis for their storage.
8. Retention period of personal data
8.1. Personal data shall be processed for the period necessary to achieve the specified purposes, but not longer than 3 years from the date of the Webinar, and for marketing communications - until the Participant withdraws the relevant consent.
8.2. After the expiration of the storage period or the achievement of the purpose of the processing, personal data shall be destroyed or depersonalized, except in cases where the law requires their longer storage.
9. Protection of personal data
9.1. The Organizers take appropriate legal, organizational and technical measures to protect the personal data of the Participants from unlawful access, loss, destruction, damage or disclosure in accordance with the requirements of the law.
9.2. Access to personal data is available only to authorized employees and managers of the Organizers, who are obliged to maintain confidentiality.
10. Webinar holding, intellectual property and liability
10.1. The Organizers have the right to change the date, time, format, composition of speakers and the Webinar program, notifying the Participants about this via available communication channels, as well as cancel the event.
10.2. All Webinar materials (content, presentations, video and audio recordings, trademarks and other objects) belong to the Organizers and/or their right holders and are protected by intellectual property legislation. It is prohibited to copy, record, reproduce and distribute the Webinar materials without the written consent of the relevant Organizer.
10.3. The Organizers are not responsible for the Participant's inability to participate in the Webinar for reasons beyond their control (including poor Internet connection, equipment or software failures on the Participant's side, actions of third parties).
10.4. The Webinar and its materials are provided "as is". The Organizers do not guarantee that the Webinar information will meet the Participant's specific expectations; it is of an informational nature and does not constitute individual consultation.
11. Change in the Terms of the Offer
11.1. The Organizers have the right to unilaterally make changes to this Offer by posting a new version at the address of its publication. The new version comes into force from the moment of its posting, unless otherwise specified in the version itself.
11.2. Continuing to use the services and participating in events after the changes come into force means the Participant’s agreement with the new version of the Offer.
12. Final provisions and details of the Organizers
12.1. This Offer, the procedure for its conclusion and execution are governed by the current legislation of Ukraine. In the part concerning the processing of personal data of individuals on the EU market, the provisions of Regulation (EU) 2016/679 (GDPR) also apply.
12.2. All disputes shall be resolved through negotiations, and in the event of failure to reach agreement, in the courts of Ukraine in accordance with the established jurisdiction.
12.3. If any provision of the Offer is declared invalid, this shall not affect the validity of its other provisions.
12.4. This Offer is drawn up in Ukrainian. By accepting the Offer, the Participant confirms that its text is clear and unambiguous for him
